Cyber Crime: an Emerging Challenges for Law Enforcement Agencies of 21st Century: An Appraisal with Islamic Perspective

Abstract

This article is concerned with the crimes occurred in virtual space, which are the emerging challenges to the law enforcement agencies of this globe and Islamic response for combating such crimes. This paper also examinee the verity of cyber crimes with the traditional offences of similar nature and identify the criterion of punishment that would be appropriate for particular crime. It further expresses the limitations of Islamic research on this topic and encourages to study about the critical legal processes which are subject to improvement such as admissibility of electronic documents, procedure for execution of ÍudËd, QiÎÉÎ and Ta‘zÊr punishment for cyber offences. This paper highlighted the cyber security challenges and Islamic perception of cyber crime along its mechanism for combating such high-tech criminal activities.
